These Terms govern use of the AI Discoverability Toolkit, Soren, audits, repair plans, monitoring, and related services.

1. Agreement

These Terms govern access to and use of the AI Discoverability Toolkit, Soren, website audit services, generated packages, monitoring, and related services provided by Varshyl Inc. (“Varshyl,” “we,” “us,” or “our”). By using the service, you agree to these Terms.

2. Platform Purpose

The service analyzes websites for AI discoverability, structured data, crawler access, metadata, accessibility basics, security hardening, and monitoring readiness. It may generate code, prompts, explanations, and repair plans.

3. No Professional Advice or Certification

The service does not provide legal, accessibility, cybersecurity, privacy, regulatory, financial, insurance, or other professional advice. It does not certify ADA, WCAG, Section 508, security, privacy, or legal compliance.

4. User Responsibilities

  • Provide accurate website and account information.
  • Review all AI and automated outputs before use.
  • Back up websites before changes.
  • Obtain all permissions required to scan or modify a website.
  • Comply with applicable laws, platform terms, contracts, privacy rules, accessibility obligations, and security requirements.
  • Use qualified professionals when appropriate.

5. Website Scanning Authorization

You represent that you own, manage, or are authorized to analyze any website submitted. You may not use the service to probe, disrupt, exploit, or gain unauthorized access to systems.

6. AI Features

AI output may be inaccurate, incomplete, or unsuitable. You must review output before implementation. We do not guarantee rankings, citations, recommendations, traffic, conversions, compliance, or security outcomes.

7. Accessibility and Security

Accessibility checks identify common issues and possible improvements. Security checks provide limited hardening recommendations and are not penetration testing. See the full AI, ADA & Security Disclaimer.

8. Open-Source and Paid Services

Open-source components may be governed by separate licenses. Paid services may cover AI processing, automation, implementation, monitoring, support, or guided assistance. Pricing and entitlements will be shown before purchase.

9. Partner and Invitation Codes

Codes may be limited by campaign, user, website, organization, expiration, or redemption count. Codes have no cash value and may be suspended for misuse.

10. Accounts and Security

You are responsible for credentials and activity under your account. Notify us promptly of suspected unauthorized access.

11. Acceptable Use

You may not upload malware, bypass controls, interfere with the service, scrape protected data, reverse engineer prohibited components, impersonate others, violate third-party rights, or use the service unlawfully.

12. Third-Party Services

The service may rely on hosting, AI, payment, analytics, communications, code repositories, and other third-party providers. Their availability and practices are governed by their own terms.

13. Intellectual Property

Varshyl retains rights in proprietary software, branding, designs, workflows, and service content. Users retain rights in their websites and content, subject to permissions needed to provide the service.

14. Beta Features

Experimental and preview features may change, fail, or be discontinued without notice.

15. Service Availability

The service is provided “as is” and “as available.” We do not guarantee uninterrupted, error-free, or fully secure operation.

16. Limitation of Liability

To the maximum extent permitted by law, Varshyl is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost revenue, data, rankings, business opportunities, or costs arising from implementation.

17. Indemnification

You agree to indemnify and hold harmless Varshyl from claims arising from your content, submitted websites, implementation decisions, misuse, legal violations, or infringement of third-party rights.

18. Dispute Resolution and Governing Law

Contact us first at kapilav@varshyl.com. These Terms are governed by California law. Subject to applicable law, disputes will be resolved by binding individual arbitration in Alameda County, California, with qualifying small-claims matters preserved.
